Confidential information in our assessments

 

In cases where a supplier wants to submit confidential information, Byggvarubedömningen offers two alternatives:

  • To submit Non-public information for a regular assessment
  • Assessment where information is submitted with a signed Non-Disclosure Agreement (NDA)

 

Note that the documentation requirement according to the certification system Miljöbyggnad is not fulfilled when information regarding substance content is submitted as Non-public or with a signed  NDA. 

 

Non-public information
Non-public information is only visible to Byggvarubedömningen and not visible in the product database after publication. Non-public information can be submitted to our regular assessments using the appendix for Non-public information, which is available for download on Byggvarubedömningen website. The supplier attaches the Non-public information when applying for the assessment. There is no extra cost or longer processing time when the assessment includes Non-public information.

 

Non-public information can be submitted by a subcontractor, i.e. a third party. The information is not communicated to the supplier who applied for the assessment nor displayed in the product database after publication, the information is only visible for Byggvarubedömningen. The subcontractor fills in the appendix for Non-public information and mail the appendix.

It is important that the supplier who applied for the assessment informs the third party which BVB ID the assessment has been assigned so that the third party can fill in the information in the appendix.

 

If other types of information are to be handled as Non-public information, e.g., emission reports, the documentation needs to be labelled as such when choosing documentation type in the application, or clearly stated that the documentation needs to be handled as Non-public if the information is submitted by email. Only information marked as a Non-public documentation will be handled as Non-public information and will not be visible in public form in the product database. It is the supplier’s responsibility to check that all information has been processed in the desired form when the assessment is returned to the supplier for review.

Information submitted with a signed Non-Disclosure Agreement (NDA)
If necessary, a legally binding agreement can also be signed, note that Byggvarubedömningen provides the agreement. The NDA is established between Byggvarubedömningen and the supplier that will submit the confidential information. The agreement is signed by a person in the company who has legal signing rights. 

 

Information submitted with a signed NDA is only visible to Byggvarubedömningen's special assessors and case handlers and will not be shared with the supplier who applied for the assessment nor be visible in the product database after publication. All NDA assessments are handled in a secure workflow.

Note the following:

  • Classifications and listings cannot be classified. Documents that need to be public by law, such as safety data sheets, cannot be submitted with a signed NDA. 
  • NDA assessments involve extra time and have a longer processing time than a regular assessment. Please plan ahead when applying for your NDA assessment, as discussions regarding the agreement and its terms and conditions can take time. 
  • NDA assessments come with an extra cost. 

Each assessment requires a public building product declaration (BPD) which is attached to the application. If any information needs to be handled as Non-public information or as information submitted with a signed NDA, the information is omitted from the BPD. Byggvarubedömningen encourages that as much public information as possible is provided, e.g., by indicating the function of the substances such as "pigments", "plasticizers", etc. in the public BPD.
